1. Scope and Acceptance

These Terms of Service govern access to Disgruntled Outpost LLC's online storefront and related commerce services.

By using the storefront or placing an order, you agree to these Terms and the policies incorporated into them.

If transaction-specific written terms apply to an RFQ, procurement transaction, special order, professional product, restricted product, or other negotiated transaction, those terms supplement these Terms and control where they expressly differ, subject to applicable law.

2. Store and Fulfillment Model

Disgruntled Outpost offers its own branded products together with selected merchandise from third-party suppliers, manufacturers, distributors, and fulfillment partners.

Products may be made to order, personalized, supplier-stocked, supplier-fulfilled, limited-release, special-order, or offered through a procurement process.

A product appearing on the storefront does not necessarily mean that the product is physically stocked in a Disgruntled Outpost warehouse.

3. Product Information, Availability, and Pricing

We work to keep product descriptions, images, specifications, compatibility information, pricing, and availability accurate.

Supplier data, inventory, product specifications, pricing, and availability may nevertheless change.

We may correct errors, update information, limit quantities, place an order on review, or cancel an affected transaction when reasonably necessary.

If a material pricing, inventory, or listing error affects an order, we may contact the customer before fulfillment or cancel and refund the affected transaction as appropriate.

4. Orders and Payment

Submitting an order does not require Disgruntled Outpost to accept or fulfill a transaction that cannot be completed because of inventory, payment authorization, fraud prevention, product eligibility, supplier restrictions, destination restrictions, shipping limitations, listing errors, or applicable legal requirements.

Payment methods and purchasing requirements for B2B and procurement transactions are confirmed for the applicable quote or order.

The existence of a particular payment capability in Shopify does not constitute a promise that any customer or organization qualifies for a particular credit or payment term.

5. Professional, Restricted, and Application-Sensitive Products

Certain products may require additional eligibility, application, destination, compatibility, fitment, documentation, qualification, or transaction review.

Government, military, law-enforcement, public-safety, security, corporate, school, transportation, organizational, or other professional status does not by itself establish eligibility to purchase a restricted product.

Disgruntled Outpost may restrict ordinary checkout, request appropriate additional information, direct the purchaser to an RFQ or restricted-product process, decline a transaction, or cancel an affected order when necessary.

Purchasers remain responsible for ensuring that acquisition, possession, transport, storage, transfer, installation, and use of a product are lawful and appropriate for their circumstances.

6. RFQs and Procurement

An RFQ, inquiry, recommended catalog, preliminary product recommendation, or procurement discussion is not an accepted order, formal quote, award, inventory guarantee, pricing commitment, or fulfillment commitment unless expressly identified as such in a subsequent written document.

A requested manufacturer, model, specification, or SKU remains a stated requirement.

Where an alternative is appropriate, it should be identified as an alternative rather than silently substituted for the requested product.

7. Returns, Shipping, and Product-Specific Terms

The Disgruntled Outpost Refund Policy and Shipping Policy are incorporated into these Terms.

Made-to-order, personalized, supplier-fulfilled, limited-release, special-order, bulk, professional, restricted, and procurement transactions may have additional conditions disclosed before purchase or stated in an applicable formal quote, purchase order, contract, or written order confirmation.

8. Accounts and Information You Provide

You are responsible for providing accurate order, account, contact, eligibility, billing, and shipping information.

Do not submit full payment-card information, Social Security numbers, medical information, or sensitive qualification records through an ordinary contact or RFQ form.

If additional qualification documentation is required, Disgruntled Outpost will identify an appropriate review process.

9. Acceptable Use

You may not:

- use the storefront for unlawful activity;

- interfere with or attempt to compromise the storefront or related systems;

- attempt unauthorized access;

- submit fraudulent, deceptive, or unlawful orders or information;

- misuse automated systems to interfere with ordinary storefront operation; or

- reproduce, scrape, exploit, or misuse protected content in violation of applicable law or applicable intellectual-property rights.

10. Intellectual Property

Disgruntled Outpost branding, original artwork, designs, written content, and other proprietary materials are owned by Disgruntled Outpost LLC or used under applicable rights.

Third-party names, trademarks, logos, product images, descriptions, and other materials remain the property of their respective owners.

Displaying third-party products or marks does not by itself imply sponsorship, endorsement, affiliation, or partnership beyond the applicable commercial relationship.

Nothing on the storefront grants a license to use another party's intellectual property except as necessary for ordinary use of the storefront.

11. Third-Party Services and Suppliers

Parts of the storefront or transaction process may rely on third-party platforms, payment processors, suppliers, production partners, carriers, verification providers, communications services, and other service providers.

Their services may be subject to separate terms and availability.

12. Disclaimers and Limitation of Liability

To the fullest extent permitted by applicable law, the storefront and its content are provided on an as-available basis.

To the fullest extent permitted by applicable law, Disgruntled Outpost LLC will not be liable for indirect, incidental, special, consequential, or punitive damages arising from use of the storefront or products.

Nothing in these Terms excludes, restricts, or limits liability, warranties, remedies, or consumer rights that cannot lawfully be excluded, restricted, or limited.

13. Governing Law and Mandatory Rights

These Terms are governed by applicable law.

Any contractual choice-of-law, venue, limitation, or similar provision remains subject to mandatory consumer protections, jurisdictional requirements, and other rights that cannot lawfully be waived.

14. Changes to These Terms

We may update these Terms as the storefront, products, suppliers, services, business practices, or legal requirements change.

The current version and its most recent update date will be posted with the Terms.

15. Mobile Messaging Terms

By affirmatively opting in to Disgruntled Outpost text messaging, you agree to receive recurring promotional text messages from Disgruntled Outpost LLC at the mobile number you provide. Messages may include product updates, releases, promotions, Outpost alerts, and, where enabled, cart-reminder messages.

Consent to receive marketing text messages is not a condition of purchase. Message frequency varies. Message and data rates may apply.

You may opt out of promotional text messages at any time by replying STOP. For help, reply HELP or contact support@disgruntledhq.com. After an opt-out request, you may receive a confirmation message and then no further promotional text messages unless you opt in again.

Text-message delivery is subject to wireless-carrier and network availability. Carriers are not responsible for delayed or undelivered messages. You are responsible for providing a valid mobile number that you are authorized to use and for notifying us if that number changes.

We may use third-party messaging providers to operate the SMS program. The handling of personal information associated with the program is described in our Privacy Policy.
